Privacy issues are made more challenging by a tougher HIPAA, growing cyber risks

With today's more rigid regulatory environment, privacy and security challenges are on the rise in healthcare. Cyber crime continues, and patient information is becoming more difficult to secure. I have read recently that cell phones can be downloaded with spyware allowing remote monitoring of phone calls, text messages, other stored information, and even when turned off, monitoring of conversation in the area near the phone. These programs also allow monitoring of location of a phone, so that travel can be monitored in real time. I do not see any evidence that the major cell phone providers or pda operating system providers are developing effective antispyware programs for phones, and as I understand it remote downloading of these spy programs will soon be possible (meaning even if phone never leaves your possession it can be impacted) and once installed, the spyware is undetectable. This seems like a HUGE problem, and one that is suspiciously off of the media's radar. The best mobile pda is worthless if insecure. Interested in your comments/feedback.
